1. Acceptance of Terms

By accessing or using Orvian Studios (“the Service”), operated by Oliviat-Autonomy (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Orvian Studios is an AI-powered marketing video and image creation platform that allows users to generate, edit, and publish content to social media platforms. The Service operates on a credit-based subscription model.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

5. Credits and Billing

The Service operates on a credit system. Credits are consumed when you use AI-powered features. New accounts receive a one-time trial credit allocation. Paid subscription plans and credit top-up packs are available for purchase. Credits do not expire. All payments are processed securely via Stripe. Subscription fees are billed in advance on a monthly or annual basis. Refunds are issued at our sole discretion.

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, abusive, defamatory, or violates third-party rights
  • Impersonate any person or entity
  • Attempt to gain unauthorised access to the Service or its infrastructure
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Violate any applicable laws or regulations
  • Infringe the intellectual property rights of any third party

7. Intellectual Property

You retain ownership of any original content you upload to the Service. By uploading content, you grant us a limited, non-exclusive licence to process and store that content solely to provide the Service. AI-generated outputs produced using the Service are owned by you, subject to the terms of the underlying AI model providers. The Orvian Studios platform, brand, and technology are owned exclusively by Oliviat-Autonomy.

8. Third-Party Services

The Service integrates with third-party platforms including YouTube, TikTok, Instagram, Facebook, X (Twitter), and LinkedIn for content publishing. Your use of those platforms is governed by their respective terms of service. We are not responsible for any actions taken by those platforms.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Oliviat-Autonomy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time via the billing portal. Cancellation takes effect at the end of the current billing period.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
